Planning ahead

A solicitor can help you with:

  • A will, saying who inherits your estate, who looks after your children, and who deals with it all (your executors).
  • Lasting powers of attorney, letting people you trust make decisions about your finances or your health and care if you can’t.
  • Trusts, for example to protect money for children or a vulnerable relative.

To be valid, GOV.UK says a will must be made voluntarily by someone aged 18 or over who is of sound mind, in writing, and signed in the presence of two witnesses over 18, who then sign it in your presence. Witnesses and their married partners cannot inherit under it.

After someone dies

If you are an executor or a close relative, a probate solicitor can:

  • value the estate and deal with banks, pensions and property;
  • apply for probate, or letters of administration if there is no will;
  • work out and pay any Inheritance Tax;
  • pay debts and distribute the estate to the people entitled to it.

You can do this yourself; GOV.UK explains how. Many people use a solicitor when the estate includes property, the will is unclear, or family members disagree.

Comparing prices

For uncontested probate where all the assets are in the UK, SRA-regulated firms must publish price information under the SRA Transparency Rules. Ask whether the fee is fixed, hourly or a percentage of the estate, and what is included.

Common questions

Do I need a solicitor to make a will?
No, but a solicitor can make sure it is valid and does what you intend, which matters if you own property, have children from different relationships, or run a business. GOV.UK says a will must be in writing and signed in front of two witnesses aged over 18, who then sign in front of you.
Can a witness benefit from my will?
No. GOV.UK says you cannot leave your witnesses, or their married partners, anything in your will.
What is probate?
Probate is the legal right to deal with someone’s property, money and possessions after they die. You don’t always need it. See GOV.UK — applying for probate.
Are will writers the same as solicitors?
No. Solicitors are regulated by the SRA and must hold insurance. Many will writers are not regulated. This directory lists SRA-regulated firms only.
