What a family solicitor can help with

Family law covers the legal side of relationships and family life. A family solicitor can:

  • help you and a former partner agree arrangements for your children, or apply to court if you can’t agree;
  • advise on dividing money, property and pensions when a relationship ends;
  • help you get protection from domestic abuse, such as a non-molestation or occupation order;
  • draw up cohabitation, prenuptial or separation agreements;
  • act for you in care proceedings if the local authority is involved with your children.

How to choose a family solicitor in Coventry

  1. Check they are regulated. Every firm on this page is authorised by the SRA. You can confirm any solicitor on the SRA register.
  2. Ask about experience with your kind of case. Children, money and domestic abuse cases need different experience. Ask who will handle your case day to day.
  3. Ask about accreditation. Some family solicitors hold specialist accreditation from the Law Society or Resolution. Ask the firm what its solicitors hold.
  4. Get the cost in writing. Ask whether the fee is hourly or fixed, and what is and isn’t included.
  5. Think about how you want to communicate. If you have children or work shifts, ask about evening calls or video meetings.

Mediation and going to court

Courts expect separating couples to try to agree where it is safe to do so. For most applications about children or money you must first attend a Mediation Information and Assessment Meeting (MIAM). Exemptions apply, including where there has been domestic abuse. A mediator is neutral; a solicitor advises you alone. Many people use both.

If you are experiencing domestic abuse

If you are in immediate danger, call 999. A family solicitor can apply urgently for a court order to protect you. Legal aid is available for protection from domestic abuse, and your income may not stop you getting it. See GOV.UK’s guidance on domestic abuse for support services.

Common questions

Do I have to go to court to sort out arrangements for my children?
No. Most separating parents agree arrangements themselves or with help from a mediator. Before you can apply to court for a child arrangements order, you usually have to attend a Mediation Information and Assessment Meeting (MIAM), unless an exemption applies, such as domestic abuse.
Can I get legal aid for a family problem?
Only in some situations. GOV.UK says you may get legal aid for advice on finances, children or divorce if you have been in an abusive relationship, if a child is at risk of being taken into care, or for family mediation. Use the GOV.UK legal aid checker.
What is the difference between a family solicitor and a divorce solicitor?
Divorce is one kind of family work. Most family solicitors handle divorce, but many also handle children, cohabitation and domestic abuse cases. If your question is about ending a marriage, see our divorce solicitors page.
How much does a family solicitor cost?
It depends on the firm and how complex your situation is. Many firms charge by the hour; some offer fixed fees for set pieces of work. Ask each firm for an estimate in writing before you start.
