How divorce works in England and Wales

Since 6 April 2022 divorce has been no-fault: you state that the marriage has broken down permanently, without blaming anyone. You can apply alone or jointly with your spouse, online or by post, once you have been married for over a year. The same process applies to ending a civil partnership.

Why the finances matter most

The divorce itself is usually straightforward. Dividing money, property and pensions is where a solicitor adds most value. Without a court order, financial claims between former spouses can stay open. A solicitor can help you agree a settlement and turn it into a consent order approved by the court, or represent you if you cannot agree.

Choosing a divorce solicitor in Coventry

  • Ask whether they handle financial settlements, including pensions and business assets if relevant.
  • Ask about fixed fees. Some firms offer a fixed fee for the divorce itself and quote separately for finances.
  • Ask about non-court options such as mediation or collaborative law, which can cost less and reduce conflict.
  • Check the SRA register. Every firm on this page is regulated by the SRA.

Common questions

How long does a divorce take?
At least about 26 weeks. GOV.UK says you must wait 20 weeks after the court issues your application before applying for a conditional order, then at least 43 days (6 weeks and 1 day) after the conditional order before applying for the final order. Sorting out finances can take longer.
Do I need a solicitor to get divorced?
No. You can apply yourself on GOV.UK. Many people use a solicitor for the financial settlement, or if the divorce is disputed, complicated or involves significant assets or a business.
Does the divorce settle our finances?
No. The divorce ends the marriage; it does not divide money or property. GOV.UK says that if you want a legally binding arrangement, you must apply to the court for it before you apply for the final order.
How much does a divorce cost?
There is a court fee to apply, shown on GOV.UK, and you may be able to get help paying it. Solicitors’ fees are separate. Some Coventry firms offer fixed-fee divorces; ask what is included.
