What an employment solicitor can help with

  • settlement agreements, which you must take independent legal advice on;
  • unpaid wages, holiday pay and contract disputes.

For employers: contracts and handbooks, disciplinary and grievance procedures, redundancy, and defending tribunal claims.

Act quickly: time limits and Acas

GOV.UK says you usually have to make a claim within 3 months of your employment ending or the problem happening, and that you must tell Acas before you make a claim. The clock pauses while Acas helps you try to resolve the dispute. Speak to a solicitor early, and don’t wait for an internal appeal to finish before checking your deadline.

What it costs

SRA-regulated firms must publish price information for unfair or wrongful dismissal claims at a tribunal, for employees and for employers, under the SRA Transparency Rules. Ask whether you have legal expenses insurance, often part of home insurance, or trade union support that could cover your costs.

Legal aid is not normally available for employment disputes, but discrimination is one of the areas GOV.UK lists as potentially eligible. Check on GOV.UK.

Common questions

How long do I have to make an employment tribunal claim?
GOV.UK says you usually have to make a claim within 3 months of your employment ending or the problem happening. The time limit is put on hold while Acas helps you try to resolve the dispute.
Do I have to contact Acas first?
Yes. GOV.UK says that before you make a claim to an employment tribunal, you must tell Acas. Taking part in early conciliation after that is voluntary.
Do I need a solicitor for a settlement agreement?
For a settlement agreement to be valid, you must receive independent legal advice on it. Employers often contribute towards the cost of that advice.
How much does an employment solicitor cost?
SRA-regulated firms must publish prices for bringing or defending unfair or wrongful dismissal claims at a tribunal. Some solicitors offer no-win, no-fee arrangements; ask exactly what you would pay if you win.
